Spring Design, the makers of the Alex eReader have sued Barnes & Noble, it’s a trade secret lawsuit against B&N. The allegation is that “the two companies had been in contact with each other over ereader designs since the beginning of the year, with various executives exchanging calls, meetings and product details under NDA” (Engadget) According to web20lawyer:
In these situations, non-disclosure agreements are not very strong defenses. Many companies in the e-book universe (like B&N) were likely to be looking at various e-reader designs at the time Alex was shown. Without something more substantial (like a patent), it is likely that B&N would be fine relying on one of the standard exceptions to NDA (e.g. independent development). As Internet and IP Lawyer, i would advise more caution when first considering pitching ideas to large companies.
It seems nothing to worry about the release of nook. However, since nook is not out yet (still one month left to get it on-hand), and ereader enthusiasts are pre-odering the device, this news has created a lot of confusion whether we’ll really ever see the real nook. B&N didn’t explain anything about the case or make any comment yet. Unless the clouds of confusion is clears the sale of nook might get hurt. PaidContent has published a recent report saying:
Spring is asking for unspecified damages and both a preliminary and permanent injunction against the sales of B&N’s nook e-reader.
